The jurors knew that either Quinzell McCall or one of the five youths who accompanied him from North Philly to Fairmount to play a game of “Who Can Catch the Most Bodies” was responsible for the murder of Robert Pierson. But, because of gaps in the prosections case, they found McCall not guilty of both first- and third-degree murder just before 2 p.m. today.
The announcement sent members of Pierson’s family, and some of his still-young friends, into both tears and rage. In fact, a Sheriff’s Officer got into a near-tussle with one of the kids outside, a near-fight that was averted when more officers, and calmer-headed relatives came outside the Criminal Justice Center.
“I was hoping for one of the degrees of murder,” said ADA Carmen Lineberger after the verdict. She’d told the family afterwards, in the courtroom, that she thought the jury might have thought George Graves was the triggerman. “Obviously, they had reasonable doubt about who the shooter was.”
That was exactly the point of defense attorney David Nenner’s closing argument. And that’s exactly what happened, according to two jurors who, approached after leaving the CJC spoke on the condition of anonymity. “It was the DA’s lack of evidence. That’s basically it,” one explained. “They had nothing concrete. Nothing solid.”
The pair said that some of the jurors wanted to find McCall guilty, but when they followed the letter of the law, they just couldn’t do so. “We can’t be vigilantes,” one explained, “regardless of what you think happened and regardless of how you feel.
“There’s no question that somebody shot that boy. Now, the question becomes whom? That was up to the DA to answer, and they didn’t.”
McCall, however, was found guilty of possessing a firearm and another weapons related charge. Meanwhile, as a Daily News reporter interviewed them after the trial, Pierson’s relatives, including his mother Patty Rounds, were livid. In tears, they blasted a system that let a murderer (whether it be McCall or a co-defendant who ratted him out in exchange for dropped charges) walk free. Theirs were tears of pure anger and utter frustration, as they said that nobody’s being held accountable for killing their loved one in cold blood.
Now, McCall remains in custody awaiting an Oct. 17 sentencing on the weapons charge which, while not clear at this point, probably adds up to about 5 years in prison.

i cannot believe that nobody is being held accountable for what happend to my little cousin. we went from six kids who were all involved one way or another to nothing,nobody.the man quinzell mcCall, has a year in jail allready and will be out in just a couple months.
i am dissappointed in every person who handled this case. from the police and detectives to the DA ,today is a sad day for philadelphia’s judicial system. they failed the peirson family the rounds family and everyone who ever knew robert. whats next.who is gonna be the next (body caught). should i take my jewlrey off. start wearing dirty cloths so im not a target,or do i fit the criteria.i am at a loss for words.i would love to know what went wrong WHO ISNT DOING THIER JOB!!!! i was the kid in a near tussle with the sheriff. that was caused by Quinzell’s cousin who rode the elevator down with me and some of my family, there was a reporter on the elevator too she was a tiny asian woman. the cousin said to us with a smile that her cousin will walk the streets again. and i was pissed and i lost it. can you blame me.. as she left cjc she did a dance and ran her mouth the whole time. none of them sheriff’s told her to shut up well i was louder but emotions were high. i would like to know why this wasnt a hate crime they crossed girard ave looking for white people. they picked a fight with white kids . a white kid was shot and killed .what is going on. i wish i knew.some one should ask philadelphia what they think can you get transcipts from the trial so everybody can hear how they picked thier (bodies). i wish i diddnt feel so helpless but i am. something needs to be done…………. sicerely,,,

This boy needs to be held accountable for the death of my cousin, before he hurts someone else. The Philadelphia’s judicial system failed our family not to mention Robert. The Rounds and Peirson families are suffering. Quinzell Mcall should have gotten more than what was given him and not a slap on the wrist. It’s not right for killers to walk. So they can go do it again. What will it take for police, detectives, and the DA to do there job RIGHT! KILLERS need to get the death penalty or at least spend thier life in prison, Not to walk free!! And if it were a white kid that killed a black kid, they would do life, with a whole media circus, saying it was racualy motivated killing. Now our family is one less because some kid decided that he wanted to shoot a white guy in a white neighborhood. Now what do we do? first and foremost I want to say thank god for quinzell’s mccall being found not guilty.Yes a life was lost but you can’t justify pierson’s death by taking the life of another.Far as I am concern due to lack of evidence he did not do it. All of the boys changed their story at least twice just to save their own life.They were willing to say whatever it took to get them home.Including pointing the finger at thier own friend.Somewhere along the line the truth was lost.Yes someone should be puinshed,but you can’t just lock a person up becauses you think they did it.You need proof.And becauses thier was no proof my bestfriend was set free.

Philly is a disgrace! How could they let that kid free? We all know what the evidence looks like, and trust me that kid aint walking the streets free. If I were him I would move to another country. If they even gave a chance to let Rob live I can more than guarantee they woulve been friends because Rob did not discriminate on anyone. However, Quinzell thought he was cool with his gun and took a life that was cut too short. Quinzell will suffer for the rest of his life. Yesterday was yet ANOTHER heart breakingg day for the ROUNDS & PIERSON family,friends and all those who knew Rob. Philadelphia is one of the worst city’s with crime rate right now, and you tell me that they had SIX kids there who ammited to getting in these fights and being there and you let them ALL walk away free while knowing one of them took the life of Rob. If you couldn’t find out who really did it, then those kids should have stayed in jail and never got the easy pass out . Whatever happened to people being accomplices to a murder? yeah i forget, this justice system is a joke. You let murderers walk the streets again just to go kill someone else. How many more people have to be killed for this city to wake up and realize? sad sad sad. Not one of the six kids (which one was with no reasonable DOUBT the shooter) will ever feel sorry for taking Robs life, or changing the life of us all. We will never feel any peace in our hearts. A lie detector test should be used on all 6 boys to find out who did this and should be accountable for this crime. So all families and rob can rest in peace. You do the crime you should do the time. It’s no different if someone robbed a store and you are in the car everyone is accountable for that crime. This is no different. To the family of Robert Pierson: I am truly disappointed with the verdict regarding your son’s murder. I think that we live in a society where violence is acceptable and accountability for one’s actions no longer exists. I pray that that you all somehow find the peace of God in your hearts because the injustice you have been served is a hard pill to swallow.
To Michael Nutter (most likely the next mayor of Philadelphia): We are counting on you to help all of us in Philadelphia with crime and gun control. These youths that killed Rob were carrying an illegal hand gun. I can only imagine how many more children are out there with guns….the numbers are probably in triple digits. I know crime happens all over the city but lets be honest with one another, it occurs on a daily basis in North Philadelphia…the lifestyle of guns and murder is completely normal to these people and now they are taking their fire storm to other neighborhoods. In addition to your plan of “frisking” and “questioning” you need to “educate”. I suggest a program that starts with the parents and grandparents of these children that tries to show them what a life of true freedom can be like. When I use the word freedom I mean an education, basic human skills and an understanding of the value of life, not a prison sentence that has reached its completion.
To the Jurors of the Pierson Case: Shame on you….all of you. Not only did you fail the Pierson family with your verdict you failed the youth of Philadelphia! You have just proven to the youth that is okay to acquire an illegal fire arm..walk into the street…kill a person and get off with no consequences. I will place blame on all of you each time I hear on the news youth on youth violence and murders. I don’t know how you will put your head to your pillow each night and sleep.

Your actions are the reasons why “African Americans” are perceived the way there are and you are only letting yourselves down. Shame on you if you see no wrong…your “beloved” stole a life. I do not live in Fairmount…I lived in Roxborough my entire life which makes me a true Philadelphian…so to all of you who are going to write back with any backlash I say this….I am entitled to my opinion and owe it to the Piersons and the citizens of Philadelphia to be honest and not politically correct.

i want the family of quinzell to just stop and think, what if he was killed by rob? and rob was found not guilty and we came on here saying all of this unecessary stuff to you? & if your going to write “quinzell didnt do it because theres no evidence”. actually you have no idea, BUT the people who took the stand were there and KNOW that quinzell did it because they SAW him, all you have is his word. and when he is in his 60’s and probably in jail hes going to have to stop and think, and realize what he did. nothing can compare to taking someones life, and we dont want him in jail just to make up for rob not being here, we want him in jail because he did it & should man up to it. okay so u think hes so big and “gangsta” for taking someones life? no, hes not at all. because hes too scared to say he did it.
My son (freddy) was sobbing and unconsulable as he told me the jury’s verdict. My family is grief stricken all over again. We lost a beloved member of our family, a child we all love and had great expectations for.
I read the testimony and closing arguements for this case and all I can say is OMG. Is this the kind verdict what all murder victims and their families can expect?
I am asking every Philadelphian, in the city and surrounding areas, to submit their own Victim’s Impact Statements to the Judge. Everyone of you are victims in this crime. Wether you are a family member/friend of Robert, or of one of the other over 200 victims this year. Please, send Impact Statements. Philadelphians are tired of burying our children.
The second annual In Memory of Robert baseball tournament is taking place this weekend. It seems like every neighborhood has some kind of sports tournament, another child killed, another mural, another tournament. Does the city have enough walls for these murals? Does the city really care. Yesterday’s news is just that yesterday. Our pain and suffering is today and tomorrow, with no end. We mourn for our loved one, along with the other over 200 families of murder victims in our city(will we reach 300?).
Please come out and show support not only for the memory of our child’s death, but for all of the murder victims in the city.
and to Q, please refrain from commenting any further dear. All you are doing is showing your ignorance and disregard for human life. Go to church and pray for your soul and the soul of your best “friend/cousin”. Burning in hell for eternity is a much greater punishment than any court could give. Your little dance in front of my family after the verdict was a short lived victory dance at the most. Eternity, thats how long a soul burns in hell.

Where were Rob’s friends when the shooting happened? Why did the prosecutor only have Quinzell’s friends as witnesses? Out of all of the friends of Rob out there fighting and beating on 13 year olds, not one of THEM could make an identification. So I ask you….WHO LET ROB DOWN???????????
Federal Civil Rights charges should be considered! The murdered teen’s family should also sue every family involved in the boy’s death with Civil Rights violations and unlawful death. It’s not over yet!

There is ALWAYS ‘reasonable doubt’. I can shoot a man, videotape it.. confess to it.. then later claim it wasnt me. That it was racist to even try me, and the racist cops and DA ‘fabricated’ evidence.
SOMEthing will ring with the jurors, enough to instill ‘Reasonable Doubt’ Or so they claim.
These idiotic jurors and friends of these waste-of-life killers need to ask themselves, what is ‘UNreasonable Doubt’ then? You NEVER will have 100% surety that the guy did it, no matter how much mountain of evidence there is.

why are people on here talking down about robs friends? they were all standing right there fighting with him, and yes im sure their mostly all still in shock, you know they did watch their friend get shot or maybe they didnt wat to go up because they fear they might be next, quinzell’s friends testified to save themselves, no other reason. and this black and white problem back and forth, yes we do have black friends & no we dont hate all black people but of course were not going to be friends with the kids who start trouble with us or who took robs life. just like they do not like us white people, they have no reason to not like us? it was a racist crime, they could have robbed and killed someone in the black neighborhood or indian or puerto rican or some other little area but no they decided they were going to come down to the “white turf”
My family was very upset over Rob’s death. None of us wanted this to happen or for him to die, but he did play a big part in causing his own death as did the woman who sent him and his friends to attack my nephew and his friends. It is a fact that Rob hit one of those boys on the head with a bottle that could have killed or seriously injured someone. If Quen and his friends were causing trouble, then the police should have been called to handle them. Rob and his friends took the law into their hands when they started the fight. All involved have to live with this, but we will not hide our happiness over the verdict. The trial was full of lies, including lies about me, and as bad as it is that a young boy lost his life, it would have been another tragedy if the wrong person had to pay for it. We are extremely pleased with the verdict and we will continue to express our happiness. For us this is not racial, and has never been racial. I responded in the elevator to a bunch rob’s family, because of the threats i heard some of them saying. They were violent “I got a gavel in my basement”, “I’ll get him”. Who in their right mind wouln’t say anything when someone is threatning someone in their family? Rob did not deserve anything that happened, and what is with all of this, why didnt they call the cops bull? As for Quinzells sister saying he is the sweetest kid on earth, I dont know any good kid that goes out with a gun to rob people and then winds up shooting an innocent kid. I mean how good could he have possible been? And also someone said Justice was served in the courtroom that day. Rob wasnt a angel, NOBODY is. He wasnt perfect, he did normal teenage things,but one thing was he wasnt out there running around robbing people, killing people, rapping people and everything else. But he was a great person and friend. He was a senior in high school, a wonderful baseball player. He had a future ahead of him, one day get married have his owns kids, everything he had ahead of him, but no some little PUNK took that away from him, gave him no chance. He was my bestfriend, we have to feel our pain everyday but im so tired of people trashing him. Nobody deserves what he got.

I am a distant cousin of the Piersons and i grew up my whole life with Robert on the same block… i remember playing crate ball and hockey and playing soldier in my basement … I obviously cant say i know Robert more than his family, but for Christ sake i grew up with the kid. I understand the general story of what went down and how my cousin was brutally murdered. I do not know the specifics of what was discovered during the trial or even how the trial went besides the oh so grueling title of NOT GUILTY. I do not know that much of the judicial or how it runs. I do understand that you are innocent until proven guilty. So i can respect that aspect of the decision.
